All matters listed under the Consent Agenda will be considered by the Commissioners Court to be routine and will be enacted by one motion in the form listed below. There will be no separate discussion of these items unless members of the Court or persons in the audience request that specific items be moved from the Consent Agenda to the Regular Agenda for discussion prior to the time the Commissioners Court votes on the motion to adopt the Consent Agenda.

All matters listed on the Consent Agenda and Regular Agenda may be discussed in Executive Session at the discretion of the El Paso County Commissioners Court and following verbal announcement, if an appropriate exception to the open meeting requirement of the Texas Open Meetings Act is applicable.

A.Pursuant to the Texas Local Government Code, Section 115.021, audit and settle all accounts against the County shown on the attached listing and direct the payment of those accounts.

C.Approve and authorize the County Judge to sign the SubRecipient Commitment Form from the University of Texas at El Paso for collaborative research with the Office of Criminal Justice Coordination regarding Crime and Victimization on the US-Mexico border: A Comparison of Legal Residents, Illegal Residents and Native-Born Citizens in El Paso Texas, from January 1, 2020 through December 31, 2020.  The amount of the sub-award is $2,524.  No County match is required.  (Contract No. 2019-0349)

D.Approve and authorize the County Judge to sign the grant award from the Texas Council on Family Violence for the District Attorney's Office, in the amount of $20,000, for a pilot program which monitors jail calls on domestic violence cases from June 24, 2019 through August 31, 2019.  There is no County match.  (Contract No. 2019-0388)

E.Approve and authorize a budget amendment to increase the FY19 Justice of the Peace Technology Fund approved budget in the amount of $3,383.  This amendment request is to supplement the difference between four Surface Pro 3 quoted at $5,583.92 which are no longer available, to the recommended quote of 4 newer model Surface Pro 6.  The request is also needed to supplement the increased cost plus the accessories which are no longer included in the original price.  Funding is available in SR-JPTECH-OPS CONTINGENCIES.   Further, approve the re-allocation of funds in the amount of $3,383 from SR-JPTECH-OPS CONTINGENCIES to SR-JPTECH-OPS-EQUIPMENT.

8.Discuss and take appropriate action regarding the 86th Legislative Session, to include presenting information for the Court’s consideration, removing or including bills on the County’s state legislative agenda and supporting or opposing filed legislation, and take any action necessary on aforementioned items.

9.Approve and authorize the closure from July 4, 2019 to sunrise on July 5th 2019, of Flager Street (north of the Exxon Gas Station), Krag Street (south of the intersection of Marvin Lane), Vista Del Este Street, and Stansbury Street.  All streets lead into residential areas that are affected by hazardous and unsafe conditions due to high volume of pedestrian and/or vehicle traffic on Independence Day.

10.Receive a presentation from the Public Works Department, Infrastructure Division on the 2019 proposed County Stormwater Mitigation Program, and authorize the Public Works Department to use Stormwater funding to address the proposed Stormwater projects presented in the amount of $3,750,000.  Funding is are available in GF-GADM-XFER OUT.

11.Approve the purchase of one 15 Passenger Van for the County of El Paso using Texas Smartbuy Contract 070-A1 awarded to Sam Pack’s Five Star Ford and Chevrolet of Carrollton, Texas in the amount of $48,963.  Funding is available in SG-STONEGARDEN-CAP OUTLAYS.

12.Approve and authorize the leasing of Electronic Monitoring Services for the Juvenile Probation Department using General Services Administration (GSA) Contract GS-07F-0003Y awarded to Alcohol Monitoring Systems Inc., dba Scram Systems of Littleton, CO., as indicated in the tabulation. Purchasing approved on 6/18/2018.  Funding is available in GF-JPD-PROF SVC-GEN.

GRANT APPLICATIONS

Approve the submission of County grant applications as listed and described. If awarded, all grant award agreements will be brought back to the Commissioners Court for final acceptance and approval.

13.Approve and authorize the Planning and Development Department to apply to the FY2020 State Rural Public Transportation Grant to the Texas Department of Transportation (TxDOT) in the amount of $437,471. No County match is required.  Further, authorize the County Judge to sign the Certificate of Obligation as required by the grant.  (Contract No. 2019-0413)

BUDGET AND FINANCE
14.Approve amendment No. 37 to the County of El Paso’s 2018-2019 operating budget. This budgetary amendment will increase Grants by $1,550, thus increasing the overall budget of $444,509,107.06 to $444,510,657.06.

15.EXECUTIVE SESSION

Only the members of the Commissioners Court have a right to attend an executive session, except that legal counsel must be present if the executive session is held pursuant to Government Code section 551.071. In addition to legal counsel, Commissioners Court may include in executive session certain officers and employees if it finds that (1) their participation is necessary to the matter under consideration; (2) their interests are not adverse to the county, and (3) their presence will not waive the attorney client privilege. Generally, the Chief Administrator, Budget Executive Director, County Clerk's representatives, and County Auditor's Office representatives attend the closed session items based on the enumerated criteria, and certain other persons may attend based on the above-listed criteria or as otherwise provided by law.
