All matters listed under the Consent Agenda will be considered by the Commissioners Court to be routine and will be enacted by one motion in the form listed below. There will be no separate discussion of these items unless members of the Court or persons in the audience request that specific items be moved from the Consent Agenda to the Regular Agenda for discussion prior to the time the Commissioners Court votes on the motion to adopt the Consent Agenda.

All matters listed on the Consent Agenda and Regular Agenda may be discussed in Executive Session at the discretion of the El Paso County Commissioners Court and following verbal announcement, if an appropriate exception to the open meeting requirement of the Texas Open Meetings Act is applicable.

B.Approve and authorize the County Judge to sign the Local Government Investment Cooperative (LOGIC) Resolution, Participation Agreement and Trust Instrument, which authorizes the County to invest funds in an eligible public funds investment pool in accordance with the Public Funds Investment Act, designates the board of trustees of the pool as an agency and instrumentality to supervise the pool, approving investment policies of the pool, and appoints the authorized representatives and designated investment officers for LOGIC.  (Contract No. 2018-0814)

C.Approve and authorize the County Judge to sign the resolution and Application for Participation in the Texas Short Term Asset Reserve Program (TexSTAR), to invest its funds jointly with other Texas local governments in order better to preserve and safeguard the principal and liquidity of funds.  Further, designate officers for the County authorized to execute and submit the application, open accounts, deposit and withdraw funds, agree to terms for use of their website for online transactions, designate other authorized representatives, and to take all other action required or permitted by the County under the agreement with TexSTAR.   (Contract No. 2018-0815)

D.Approve and authorize the renewal of the current County of El Paso Burn Ban Order for an additional 90 days once the current ban expires on December 7, 2018.

E.Approve and authorize the County Judge to sign the Office of the Attorney General Statewide Automated Victim Notification Services (SAVNS) Fiscal Year 2019 Invoice (OAG #1876895) in the amount of $7,136.69 (Contract No. 2018-0505) and the Quarterly Verification of Continuing Production Record form for automated victim information and notification in El Paso County. There is no fiscal impact to the County general fund budget.

F.Approve and authorize the 2019 employee payroll deductions for employee benefit premiums and United Way employee contributions approved by the County of El Paso through a Commissioner’s Court order, Purchasing Department bid, County Contract, County Interlocal Agreement, or Union agreement.  Further, approve and authorize to continue current payroll deduction (grandfathered) for benefits not sponsored by the County of El Paso through a Commissioner’s Court Order,  Purchasing Department bid, County Contract, County Interlocal Agreement, or Union agreement, but not allow any new payroll deduction requests for the grandfathered benefits.

15.Approve and authorize the County Judge to allow the Public Works Department to submit an application for a potential grant with the Texas Department of Public Safety - Emergency Management, as part of the Pre-Disaster Mitigation (PDM) Grant Program, and further authorize the new proposed priority list.  There is a 25 percent County match in the amount of $2,400,000 if selected.

PURCHASING

Approve the submission of County grant applications as listed and described. If awarded, all grant award agreements will be brought back to the Commissioners Court for final acceptance and approval.

19.Approve and authorize the Domestic Relations Office to apply to the FY 2019 Office of Violence Against Women Justice for Families Program grant in the amount of $550,000 for a period of three years with no County match required. Further, authorize the County Judge to sign the Letter of Intent as a requirement of the funding agency.

22.Approve amendment No. 08 to the County of El Paso’s 2018-2019 operating budget.  This budgetary amendment will increase Grants by $200,000, thus increasing the overall budget of $433,336,033.39 to $433,536,033.39.

23.EXECUTIVE SESSION

Only the members of the Commissioners Court have a right to attend an executive session, except that legal counsel must be present if the executive session is held pursuant to Government Code section 551.071. In addition to legal counsel, Commissioners Court may include in executive session certain officers and employees if it finds that (1) their participation is necessary to the matter under consideration; (2) their interests are not adverse to the county, and (3) their presence will not waive the attorney client privilege. Generally, the Chief Administrator, Budget Executive Director, County Clerk's representatives, and County Auditor's Office representatives attend the closed session items based on the enumerated criteria, and certain other persons may attend based on the above-listed criteria or as otherwise provided by law.
