All matters listed under the Consent Agenda will be considered by the Commissioners Court to be routine and will be enacted by one motion in the form listed below. There will be no separate discussion of these items unless members of the Court or persons in the audience request that specific items be moved from the Consent Agenda to the Regular Agenda for discussion prior to the time the Commissioners Court votes on the motion to adopt the Consent Agenda.

All matters listed on the Consent Agenda and Regular Agenda may be discussed in Executive Session at the discretion of the El Paso County Commissioners Court and following verbal announcement, if an appropriate exception to the open meeting requirement of the Texas Open Meetings Act is applicable.

6.Pursuant to Texas Local Government Code Section 118.025(g), hold a public hearing regarding the County Clerk's Records Archive Preservation and Restoration Plan and the assessment of a fee for Fiscal Year 2018-2019.

7.Pursuant to Texas Local Government Code Section 118.025(b) approve and adopt the County Clerk's Records Archive Preservation and Restoration Plan for Fiscal Year 2018-2019.  Further, approve payment to the El Paso Inc. in the amount of $51.18 for the publishing of the Public Notice Hearing.  Funding is available in GF-CNTYCLK-ADVERTISING.

ECONOMIC DEVELOPMENT
8.Approve and authorize the County Judge to sign the Oñate Crossing/ Old Fort Bliss/ Harts Mill Project/ Historic Structure and Cultural Landscape/ Phase II/ Southwest Border Resource Protection Program/ Grant Award and Cooperative Agreement (No. P18AC00690 / Yr 2018-2020) from the US Department of the Interior, National Park Service in the amount of $50,000. This grant will allow the County of El Paso to complete Phase II of the ongoing Onate Crossing /Old Ft. Bliss /Harts Mill project.  There is a $5,000 County match required.  Funds are available in SR-TOURPROM-OPS CONTINGENCIES.  (Contract No. 2018-0395)

PUBLIC WORKS
9.Approve and authorize the closure of a section of Mankato Road to mitigate flooding issues that might arise during monsoon season.  The closure would be from July 16, 2018 through September 31, 2018.

10.Approve and authorize the Public Works Department to create a channel to mitigate flooding issues on Mankato Road and authorize the acceptance of donations of Real Property by residents who are impacted by flooding issues in the area.  Further approve the allocation of $150,000 from Storm Water Funds to fund the project.  Funds are available in GF-GADM-XFER OUT.

11.Approve and authorize the submission of a letter of intent to partner with El Paso Water Utilities for On-Call Professional Engineering Services for the County Interior Drainage Analysis Study that is needed for the certification of County levees.

BUDGET AND FINANCE
12.Approve amendment No. 40 to the County of El Paso’s 2017-2018 operating budget.  This budgetary amendment will increase Grants by $1,630,065 thus increasing the County of El Paso’s 2017-2018 overall operating budget of $487,297,938.53 to $488,928,003.53.

13.EXECUTIVE SESSION

Only the members of the Commissioners Court have a right to attend an executive session, except that legal counsel must be present if the executive session is held pursuant to Government Code section 551.071. In addition to legal counsel, Commissioners Court may include in executive session certain officers and employees if it finds that (1) their participation is necessary to the matter under consideration; (2) their interests are not adverse to the county, and (3) their presence will not waive the attorney client privilege. Generally, the Chief Administrator, Budget Executive Director, County Clerk's representatives, and County Auditor's Office representatives attend the closed session items based on the enumerated criteria, and certain other persons may attend based on the above-listed criteria or as otherwise provided by law.
