Subject:Approve and authorize the County Judge to sign the Cyber Liability Insurance Rate Proposal and related documents for FY24 authorizing the County’s Insurance Broker (USI Southwest Inc.) to proceed with obtaining a policy based on their Liability Insurance Rate Proposal for Cyber Insurance coverage. Funding is available in GF-GADM-INS-GEN/PROPERTY.  (Contract No. 2023-0766)
Background:

The County of El Paso’s Insurance Broker USI Southwest, Inc. provided El Paso County the estimated liability insurance rates for cyber liability insurance with Crum and Forster. The estimated rate was subsequently presented by the Human Resources Department to the Commissioners Court, during the budget meetings held on August 14, 2023.

 

The purpose of cyber-Security insurance coverage is to assist in paying for some of the expenses the County would have to pay out of pocket in the absence of no coverage for Cyber events which are an unintentional and unplanned interruption of any computer system such as:

 

  • a theft, loss or Unauthorized Disclosure of Protected Information that is in the care, custody or control of an Insured or a third party for whose theft, loss or Unauthorized Disclosure of Protected Information the Insured Entity is legally responsible for;
  • the storage, collection, use or disclosure of Protected Information by or on behalf of an Insured Entity that is in violation of a Privacy Law;
  • the failure to notify a third party of a theft, loss or Unauthorized Disclosure of Protected Information in violation of a Privacy Law;
  • a Virus Event;
  • the access to, or the use of, a computer system by a person or organization that is not authorized to do so;
  • Cyber extortion Threat such as the disclosure of protected information;
  • the corruption, alerting, deletion or destruction of data or software stored on a computer system;
  • the restriction or hindering of access to a computer system or to data stored on a computer system;
  • the interruption or suspension of a computer system; and
  • the electronic communication with the Insured Entity’s customers impersonating the Insured Entity in order to obtain Protected Information.

 

Approval of this proposal will result in the creation of a formal insurance policy. The premium in the proposal totals $38,863.

 

The County Attorney’s Office has reviewed the Cyber Liability Insurance Rate Proposal and related documents for FY24.  (Contract No. 2023-0766)
