Item Title:HR - 2023 Public Official Bonds

Subject:Approve and authorize the purchase of Public Official Bonds for newly elected, re-elected, or appointed public officials as required by the Texas Government Code and Local Government Code effective January 1, 2023, and further approve and authorize the County Judge to sign any related documents. Funding is available in various departmental PUBLIC OFFIC BOND (600306) accounts.
Background:

The Texas Local Government Code requires certain public officials to file at least one surety bond along with the elected official’s oath of office. The bond coverage amount, number of sureties, payee, and term is specific to the public office held. The purpose of the bond is to provide liability coverage on public officials for the faithful performance of the duty of their office.  In addition to these bonds, the County is a self-insured entity and does carry Crime Liability insurance with a deductible of $25,000.

 

Currently 47 public official positions in the County of El Paso are required by the Texas Local Government Code or approved by the County Commissioners Court to have at least one surety bond payable to the County or to the Governor.  Those positions are identified in the attached backup document.

 

With the recent election, staff is requesting for the Commissioners Court to approve and authorize the purchase of Public Official Bonds for newly elected, re-elected, or other public official positions as listed in the attached document. For convenience, staff also included in the attached document the remaining bonded positions that do not require action.

Fiscal Impact:

FY 2015  $24,268.50

FY 2017  $9,480

FY 2019 $25,053.50

FY 2021 $10,820

FY 2023 $25,046 (Estimated) – Already included in the FY23 budget

 

Funding is available in various departmental PUBLIC OFFIC BOND (600306) accounts.

Recommendation:Approve and authorize the purchase of Public Official Bonds for newly elected, re-elected, or appointed public officials as required by the Texas Government Code and Local Government Code effective January 1, 2023, and further approve and authorize the County Judge to sign any related documents. Funding is available in various departmental PUBLIC OFFIC BOND (600306) accounts.
Prior Action:

November 24, 2014, Agenda Item #4H, Commissioners Court authorized purchase of Public Official Bonds for newly elected, reelected, or appointed public officials as required by Local Government Code.

 

December 12, 2016, Agenda Item #3F, Commissioners Court authorized purchase of Public Official Bonds for newly elected, re-elected, or appointed public officials as required by the Local Government Code.

 

January 7, 2019, Agenda Item #3G, Commissioners Court authorized purchase of Public Official Bonds for newly elected, re-elected, or appointed public officials as required by the Local Government Code.

 

December 14, 2020, Agenda Item #4L, Commissioners Court authorized purchase of Public Official Bonds for newly elected, re-elected, or appointed public officials as required by the Local Government Code.
