Subject:Approve and authorize the County Judge to sign the Fourth Amendment to the Interlocal Agreement VRF Project Development Agreement for the Pellicano Drive Roadway Improvement Project with the Camino Real Regional Mobility Authority (CRRMA), which corrects the Commissioners Court Order of May 23, 2022, Item No. 19 on the Regular Agenda from funding source GF-EPCMP-CAP PROJ-LAND to VRF Bond Proceeds for land acquisition for the Pellicano Widening & Reconstruction Project.  (Contract No. 2022-0435) (CC PCT3)
Background:

The widening and reconstruction of Pellicano Drive is an initiative that began in 2006 as the County began to work with cooperative property owners in the area to acquire the necessary right-of-way for the expansion and reconstruction. The project is identified in the El Paso Metropolitan Planning Organization's planning documents as a project scheduled to be let for construction in 2019. Limits of the project extend from Loop 375 to Darrington Rd. for approximately 3 miles in length. Improvements include, six-lanes divided, raised median, illumination, landscaping, pavement, curb and gutter and sidewalks/bike lanes.

 

This contract and land transaction provide the County with the necessary land to construct stormwater retention ponds as part of the roadway improvements, thereby collecting runoff that has traditionally created flooding hazards along the County road. The easement is located south of the roadway and is connected via an access easement to Pellicano to ensure County maintenance crews can access the pond facility in the future.

Prior Action:

On May 23, 2022, the court authorize the County Judge to sign the Real Estate Sales Contract Access Easement & Drainage Easement with JObe Materials in the amount of $1,757,288.00, for right-of-way property and associated closing cost needed for the widening and reconstruction of Pellicano Drive. Funding is available in GF-EPCMP-CAP PROJ-LAND. (Contract No. 2021-0823) (CC PCT #3) (Item 19)

 

On February 8, 2021, the court authorize the County Judge to sign the Third Amendment to the Interlocal Agreement VRF Project Development Agreement for the Pellicano Drive Roadway Improvement Project with the Camino Real Regional Mobility Authority (CRRMA) to add construction funds to the Pellicano Widening & Reconstruction Project, and authorize the transfer of TxDOT State Infrastructure Bank (SIB) loan proceeds totaling $4.6M from the County to the CRRMA for completion of the Project. (Contract No. 2021-0049) (Item 20)

 

On December 14, 2020, the court authorized the County Judge to sign the State Infrastructure Bank (SIB) loan agreement, and all necessary documents to include the attached Resolution, in the amount of $4,600,000 with the Texas Department of Transportation (TxDOT) for the Pellicano Widening Project (CSJ 0924-06-534). Repayment of the loan will begin in FY2022 through use of dedicated ad-valorem tax revenue from the Interest & Sinking Fund. (Contract No. 2020-0974) (Item 22)

 

On October 19, 2020, the court authorize the County Judge to sign the Real Estate Sales Contract with Pellicano 121 Development, LLC in the amount of $737,838.40, for right-of-way property needed for the widening and reconstruction of Pellicano Drive. Funding is available in GF-EPCMP-CAP PROJ-LAND. (Contract No. 2020-0669) (Item 24)

 

On September 14, 2020, the court authorize the County Judge to sign the Real Estate Sales Contract between El Paso County and BAM Doniphan Investments, LLC ("BAM") in the amount of $103,683. Funding is available in GF-EPCMP-CAP PROJ-LAND. (Contract No. 2020-0256) (Item 28)

 

On March 2, 2020, the Court authorized the County Judge to sign the Second Amendment to the Interlocal VRF Project Development Agreement for the Pellicano Drive Roadway Improvement Project with the Camino Real Regional Mobility Authority to add construction funds to the Pellicano Widening & Reconstruction Project. No County funds are required. (Item 17)

 

On July 29, 2019, the Court authorized the County Judge to sign Amendment 1 to the Interlocal agreement between the Camino Real Regional Mobility Authority (CRRMA) and the County of El Paso. (Item 14)

 

On July 9, 2018, the Court authorized the County Judge to execute the Local Transportation Project Advance Funding Agreement (LPAFA) with the Texas Department of Transportation for the Pellicano Widening Roadway project in the total amount of $10,388. (Item 3L)

 

On September 25, 2017, the Court authorized the County Judge to execute the Interlocal Agreement Vehicle Registration Fee (VRF) Project Development Agreement (design) for Pellicano Improvement Project between the County of El Paso and the Camino Real Regional Mobility Authority (CRRMA). (Item 22)

 

On April 24, 2017, the Court approved the use of VRF savings ($3,000,000) for the Design of Pellicano Improvement Project. (Item 7)

 

On March 28, 2016, the Court approve and authorize the County Judge to sign the letter of concurrence to the El Paso Metropolitan Planning Organization regarding the widening and reconstruction of Pellicano Drive (MPO Project ID: P410X-15A).

 

On December 15, 2014, the Court authorized the County Attorney’s office to prepare project development agreements with Camino Real Regional Mobility Authority for the projects that will be funded through VRF and excess VRF funds. (Item 15)
