Subject:Accept the resignation of County Court at Law #3 Judge Javier Alvarez effective September 30, 2022, and appoint candidate Melissa Baeza to fill a pending judicial vacancy in County Court at Law #3 from October 1, 2022, to December 31, 2022.
Background:

County Court at Law #3 Judge Javier Alvarez has tendered his resignation from his position as County Court Judge of County Court at Law #3 effective September 30, 2022. This agenda item represents a request for the Commissioners Court to approve the acceptance of the resignation of County Court Judge Javier Alvarez effective September 30th, 2022, whose term ends on December 30th, 2022.

 

In addition, according to Sec. 25.0009 of the Texas Local Government Code, "the commissioners court of each county shall appoint a person to fill a vacancy in the office of judge of a statutory county court."

 

We are in an election year, and Judge  Alvarez did not seek re-election, there is an unopposed candidate, Melissa Baeza, who will take office for County Court at Law Judge #3 on January 1, 2023. Therefore, this agenda item also represents a request for the Commissioners Court’s approval to appoint Melissa Baeza to fill the remainder of the Court at Law #3 unexpired term beginning October 1, 2022 and ending December 31, 2022.

 

The resignation acceptance and appointment request has been reviewed by the County Attorney’s Office. 

Fiscal Impact:There is no fiscal impact for this request.
Recommendation:Accept the resignation of County Court at Law #3 Judge Javier Alvarez effective September 30, 2022, and appoint candidate Melissa Baeza to fill a pending judicial vacancy in County Court at Law #3 from October 1, 2022, to December 31, 2022.
