Item Title:PD - Bond 48 Grant Staffing Amendment Request

Subject:Approve and authorize the County Judge to sign the letter to the Texas Indigent Defense Commission (TIDC) requesting amendments to the FY 2021 and FY 2022 48 Hour Bond Review Hearing Grant program.  Further, authorize the creation of a part-time Legal Secretary, Intermediate GS14 position as described in the amendment request, to be fully funded by this grant. (Contract No. 2021-0539)
Background:

Criminal Justice stakeholders, including the Council of Judges, County Court Administration, District Clerk's Office, County Clerk's Office, Sheriff's Office, Office of  Criminal Justice Coordination, Executive Director for Justice Support and Community Service, District Attorney's Office, County Attorney's Office, and Public Defender's Office have been working to examine El Paso County's pretrial processes, including methods of setting bond, in terms of best practice models and the ongoing litigation in Harris, Dallas, and Galveston Counties, as well as across the nation.  One of the identified options to enhance El Paso's system is the implementation of a hearing to review the bonds of each individual, who has not been released on bond, forty-eight (48) hours after the person was arrested and appeared before Jail Magistrate.  These 48 hour hearings are held seven (7) days a week, Sunday through Saturday mornings, and the accused are represented by the Public Defender's Office.

 

When the program was launched, as part of the collaboration with other departments, and to the County's fiscal burden, the Public Defender's Office revised its staffing plans to secure legal secretarial staffing on weekends and holidays, using a "DIMS" overtime model.  After almost two years of operation, it has become clear that more consistent legal secretarial staffing is needed for weekends and holidays to better support the attorneys handling 48 Hour Bond Review Hearings and better serve the clients they represent.  As a result, and in coordination with the Human Resources Department, the Public Defender's Office will be asking the Court's approval to request a grant amendment form TIDC to add a part time Legal Secretary Intermediate, who will work the majority of the weekend/holiday shifts, reducing reliance on the overtime model.  In addition to having the consistency of the same team members for these shifts, the amendment will also reduce the legal secretarial staffing costs because it will address regular hours worked.  

Fiscal Impact:The Texas Indigent Defense Commission (TIDC) Competitive Discretionary Grant Program was developed to assist Counties in developing and implementing enhancements to local indigent defense programs, especially those which will serve as models for other counties.  The staffing budget changes requested in this item will assist our office in more effectively preparing client case information for team attorneys will also reduce the fiscal cost of program operation, through the use of a part time legal secretary intermediate position instead of compensating legal secretaries through overtime.  The requested amendment will reduce the Grant budget by $26,504.61, which will reduce the County’s projected match for FY 22 by 13,252.30.
Recommendation:Approve and authorize the County Judge to sign the letter to the Texas Indigent Defense Commission (TIDC) requesting amendments to the FY 2021 and FY 2022 48 Hour Bond Review Hearing Grant program.  Further, authorize the creation of a part-time Legal Secretary, Intermediate GS14 position as described in the amendment request, to be fully funded by this grant. (Contract No. 2021-0539)
Prior Action:Commissioner's Court authorized submission of the Statement to Intent Grant Application on March 11, 2019, under contract number 2019-0149, the formal grant application on May 6, 2019, under contract number 2019-0317, and acceptance of the grant award on August 26, 2019, under contract 2019-0528.  The FY20 grant amendment and FY21 grant renewal request was tracked under contract number 2020-0371, and Commissioner's Court accepted the FY20 grant amendment and the FY21 grant award on May 11, 2020, under contract numbers 2020-0765 and 2020-0371 respectively.  The Court approved the request for an equipment amendment on April 26, 2021, under contract 2021-0164, which is also on today's agenda.
