Subject:Pursuant to Texas Local Government Code §232.0026, conditionally approve and accept the revision of Lagos Del Este subdivision to be named Lagos Del Este Replat A. Further, authorize the filing and recording of the subdivision plat once comments have been addressed in accordance with Texas Local Government Code §232.0027.
Background:

The developer/property owner is requesting the recording and approval of the above-mentioned plat by the El Paso County Commissioners Court.  This subdivision has met all State and County subdivision regulations and requirements. The owner has requested the replat to divide lot 1 into three (3) commercial lots.

Subdivision Information:

  • Developer/property owner:  EP Summit Investments, LLC
  • Precinct Location: Precinct No. 3
  •  Legal Description: Survey NO. 324, Being Block 2, Lot 1, Lagos Del Este, Subdivision. El Paso County, Texas, Containing 14.3747 Acres+.
  •  Water Provider: Paseo Del Este Municipal Utility District No. 1
    Extra Territorial Jurisdiction (ETJ): City of El Paso
    Number of lots: 3 (Non-Residential

 

In accordance with Texas Local Government Code Section 232.041:

  •  The County shall published a notice of the application in a newspaper of general circulation in the county. The notice included a statement of the time and place at which the court would meet to consider the application and to hear protests to the revision of the plat.
  •  At the time of the posting of this item, the County had received no calls for information, calls in support nor calls in opposition to the proposed replat.

The proposed plat is recommended to the Court for conditional concurrence pending adequately addressing the following outstanding comments pursuant to the El Paso County Subdivision Order Section 2.8, Sections a, b, c, d, e, o, s and u.

  •  Verify access for Lot 3 from the property to the west and via Lot 2 to the south via a specific instrument for access. Access for the lot shall not be allowed off State Street given the significant lack of frontage along that ROW.
  •  Revision of Drainage Report to accurately reference/describe that the previous temporary pond will be utilized to capture the future development of the entire site.
  •  Addition of plat notes that address the following:
    • Lot owners shall be responsible for maintaining the sidewalks, driveways and parkways abutting their respective property.
    •  Lot owners shall obtain approval from the El Paso County Planning & Development Department prior to lot development.
      Lot owner of Lot 2 is responsible for the maintenance of the private pond proposed on the property.
    •  Sidewalk along Lot 1, fronting Eastlake Boulevard, is to be constructed by developer.
    •  Driveways along Eastlake Boulevard and Gateway West are to be constructed by developer.
    •  All lots shall be restricted to non-residential uses.

Recommendation:Pursuant to Texas Local Government Code §232.0026, conditionally approve and accept the revision of Lagos Del Este subdivision to be named Lagos Del Este Replat A. Further, authorize the filing and recording of the subdivision plat once comments have been addressed in accordance with Texas Local Government Code §232.0027.
