| Background: | El Paso Community Services Department, through funding from the Texas Department Housing and Community Affairs during the 2009-2012 contract period built homes in the Agua Dulce Colonia under the Home Reconstruction Program. As part of participating in the program, a five-year forgivable loan secured by a lien was agreed upon by both the County and the program participants. The terms including maintaining homeowner’s insurance for the life of the loan period, paying their property taxes on time, and not selling, renting or leasing their property were memorialized in a Deed of Trust. The forgivable loan was amortized over the five year period and a percentage forgiven every year at a rate of 20% per year. Upon meeting all those conditions, the County would agree to release the lien at the end of five years as long as homeowner met all requirements specified in the Deed of Trust. The five year term and all conditions have been met by Benjamin Montoya and Rocio Avita. |
