Item Title:HR - Rehire of Retiree for County Criminal Court #2

Subject:Approve the rehire of County retiree Eileen Lopez, effective October 22, 2018, as a full-time regular Compliance Officer (G27) for County Criminal Court at Law No. 2, as required by Texas County & District Retirement System (TCDRS) and County policy, and further authorize her hire at a step 6.  Funds for this position have been budgeted through the SAMHSA grant (2018-0520), and there will be no impact to the County's General Fund.
Background:

This requirement comes as a result of House Bill (HB 633) that was enacted by the 79th Texas State Legislature and became effective January 1, 2006. The County also took action to include the requirement in its policies in June 2008 to make the rules regarding rehiring retirees known to our County officials and staff to ensure our hiring practices are in compliance with the law.

 

Additionally, this is a request to hire this retiree at a step higher than allowed by the County's New Hire Procedure policy. As outlined in Section II-C of the policy, "an Elected Official/Department Head may place a newly hired employee at a step higher than entry, but no higher than a step 2, as cleared with the Human Resources Department." In this case, HR has reviewed the years of relevant experience and education of this retiree, and is supportive of placing this employee at a step 6, which is $60,900.78. This salary is being reimbursed 100% by the grant, and there will be no impact to the general fund.

Fiscal Impact:The position that this retiree is being hired into is a grant-funded Compliance Officer for County Criminal Court #2. The grant was written with a salary budget of $65,755 per year for 5 years. Hiring the employee at a step 6, $60,900.78 will be within the terms of the grant. As a result, there is no impact to the general fund.
Recommendation:Approve the rehire of County retiree Eileen Lopez, effective October 22, 2018, as a full-time regular Compliance Officer (G27) for County Criminal Court at Law No. 2, as required by Texas County & District Retirement System (TCDRS) and County policy, and further authorize her hire at a step 6.  Funds for this position have been budgeted through the SAMHSA grant (2018-0520), and there will be no impact to the County's General Fund.
Prior Action:8/27/2018 - Item #11 - Approve and authorize the County Judge to accept the grant award from the Substance Abuse and Mental Health Services Administration (SAMHSA) awarded to the DWI Drug Court Program. The grant is in the amount of $387,716 per year for a period of five years for a total grant award in the amount of $1,938,580. No County match is required. (Contract No. 2018-0520)
