Subject:Approve and authorize the County Judge to sign the Permanent Easement Agreement with MAB Real Estate L.P., and authorize the County Auditor to issue a check in the amount of $5,550 plus any cost of suit due and payable by the County, and further authorize the County Attorney's Office to settle the Condemnation Suit for $16,000, which amount includes net funds in the Registry of the Court.  Funds are available in the GADM-XFER OUT-GRANT MATCH from the USDA loan for the Desert Acceptance Sewer Project.  (Contract No. 2016-0259)
Background:Funds for the condemnation expenses for the Desert Acceptance Sewer System Project , not to exceed the overall total of $250,000 budgeted by USDA for acquisition of real property, are to be paid as necessary in order to acquire all remaining easements needed for the project and related expenses of acquisition. Once the project is funded, the Public Works Department should request reimbursement from USDA for all budgeted grant amounts advanced by the County.
Fiscal Impact:

Funds are provided as part of $250,000 for land acquisition from USDA's grant for the Desert Acceptance Sewer System Project.  Ample funds remain.

Prior Action:

Commissioners Court approved the payment of $16,000 for a utility easement on 8/22/16, but the check was returned to the auditor when the closing did not occur.

 

Commissioners Court has approved a Resolution determining it is in the public interest to build a sewer project and entered into several agreements including: a Grant Application to USDA, a professional engineering contract for design of the sewer system, a waste water operating agreement with El Paso Water Utilities, and appraisal contracts for the property to be acquired with the funding requested above. Commissioners Court also authorized the County Judge to sign the Easement Agreements at its last meeting.
